Terms and Conditions of Service: You represent that you have read and agree to be bound by the terms and conditions of service ("terms") for Newsmax Media, Inc.
Privacy Protection and Opt-In Policy: We do not contact customers or viewers unless requested to do so by those individuals requiring or requesting further information from us.
1. Various Newsmax Media reports (collectively, "Reports" or "Service"), are, published by our company, including Money Matrix Insider recommendations, and offered for sale to the general public.

Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages. In no event shall Newsmax total liability to you for all damages, losses, and causes and action (whether in contract or tort, including but not limited to negligence) exceed the amount paid by you, if any, for accessing this site or service.
Indemnification: You agree, at your own expense, to indemnify, defend, and hold harmless Newsmax, and its employees, representatives, Suppliers, and agents, against any claim, suit, action, or other proceeding brought against Newsmax, its employees, representatives, Suppliers, and agents, by a third party, to the extent that such claim, suit, action or other proceeding brought against Newsmax, its employees, representatives, Suppliers, and agents is based on or arises in connection with the Service, including but not limited to your use or someone using your computer's use of the Service; a violation of the terms by you or anyone using your computer; a claim that any use of the Service by you or someone using your computer infringes any Intellectual Property Right (as herein defined) of any third party, or any right of personality or publicity, is libelous or defamatory, or otherwise results in injury or damage to any third party; any deletions, additions, insertions, or alterations to, or any unauthorized use of, the Service by you or someone using your computer; any misrepresentation or breach of representation or warranty made by you contained herein; or any breach of any covenant or agreement to be performed by you hereunder. You agree to pay any and all costs, damages, and expenses, including, but not limited to, reasonable attorneys' fees and costs awarded against or otherwise incurred by or in connection with or arising from any such claim, suit, action or proceeding attributable to any such claim.
Newsmax will not be liable for consequential, incidental, punitive, special, exemplary, or indirect damages resulting directly or indirectly from the use of or reliance upon any material provided by Newsmax. Without limitation, Newsmax shall not be responsible or liable for any loss or damages related to, either directly or indirectly, (1) any decline in market value or loss of any investment; (2) a subscriber's inability to use or any delay in accessing the Newsmax website or any other source of material provided by Newsmax; (3) any absence of material on the Newsmax website; (4) Newsmax' failure to deliver or delay in delivering any material or (5) any kind of error in transmission of material; or (6) the use by a subscriber of any research to invest in any way which may be deemed unsuitable in accordance with certain industry standards. Newsmax and Subscriber acknowledge that, without limitation, the above-enumerated conditions cannot be the probable cause of any breach of any agreement between Newsmax and Subscriber. "No-risk" and "risk-free" refer solely to the subscription price refund policy.
Termination of Terms: Either you or Newsmax may terminate the terms at will, at any time and effective immediately.
Governing Law: This Agreement shall be governed and construed in accordance with the laws of the United States and the State of Florida, without giving effect to conflicts of law principles thereof. You agree to submit to the personal jurisdiction of the state and federal courts located in the State of Florida with respect to any legal proceedings that may arise in connection with the Service or from a dispute as to the interpretation or breach of the terms of service.
Accessing Newsmax Media, Inc. Outside the United States: Newsmax does not represent that materials in the Service are appropriate or available for use in countries outside the United States. If you choose to access the Service from outside the United States, you are responsible for compliance with foreign and local laws.
Miscellaneous: You accept that Newsmax has the right to change the content or functionality of any aspect of the Service at any time at Newsmax sole discretion.
Severability of terms: If any provision of the terms is found invalid or unenforceable, that provision will be enforced to the maximum extent, and the other provisions of this Agreement will remain in force.
Agreement in entirety: The terms are the entire agreement between you and Newsmax and no amendment shall be made except in writing signed by the parties to be charged.
ACKNOWLEDGEMENT AND AGREEMENT
Not withstanding any other agreement or other communications between NEWSMAX and Subscriber to the contrary, receipt or use of any material provided by NEWSMAX, at any time and through any means, whether directly or indirectly, represents acknowledgement by such person of this disclaimer and agreement with its terms and conditions.
